What is a Recusal and when should a judge recuse themselves
•In the state of New York, judges are required to recuse themselves from any case where their impartiality might reasonably be questioned. This includes scenarios where they have a personal bias or prejudice concerning a party, or personal knowledge of disputed evidentiary facts concerning the proceeding. Additionally, judges must recuse themselves in cases where they, their spouse, or a person within the third degree of relationship to either of them, or the spouse of such a person:
1. **Is a party to the proceeding, or an officer, director, or trustee of a party.**
2. **Is acting as a lawyer in the proceeding.**
3. **Is known by the judge to have an interest that could be substantially affected by the outcome of the proceeding.**
4. **Is to the judge’s knowledge likely to be a material witness in the proceeding.**
Judges also need to consider their financial interests, and recuse themselves if they have a financial interest in the subject matter in controversy or in a party to the proceeding.
If a judge’s impartiality might reasonably be questioned, or if recusal is requested by a party and the judge believes there is no basis for recusal, the judge must disclose on the record the basis of the judge’s denial of the recusal. The rules governing judicial conduct in New York aim to ensure fairness, prevent any conflicts of interest, and maintain public confidence in the judiciary's integrity.
