In this episode we welcome back Mark Petrovich and Thomas Walsh for part 2 of our episode about sentencing. Last time we focused on federal sentencing so now we turn the focus to sentencing in the state courts when someone is convicted of a criminal offense. We explore different ways people can be sentenced. Sometimes there is an agreement with a prosecutor for specific sentence, sometimes the prosecutor agrees to a cap, sometimes the prosecutor agrees to the low end of the guidelines, etc. Often times there is no agreement on sentencing and someone has plead straight up to the judge and the judge will decide what will happen. Finally, when there is no plea of guilty or an agreement as to sentencing and a judge or jury finds someone guilty there are different issues that arise following a trial when it comes time to what punishment someone receives from a judge or jury.
